What is Mediation?

Mediation is a voluntary process. It is a meeting between two or more people in conflict. A trained mediator, who is not part of the conflict, helps the group have a conversation. In this conversation the participants create their own ideas for solving their problem.

Mediation is different than going to see a judge or an arbitrator, where their ruling is final and often times, impersonal. At MNM we do not make decisions for you. We use mediation to help you find a solution that works for everyone involved.

The mediator helps everyone communicate with each other in an empowering way, moving towards resolution. The mediator does not directly give advice, take sides or come up with solutions. Instead, the mediator controls the conversations so that they move forward in a positive direction that both parties agree upon. When a solution is found, we will help write up the documents need to finalize your decisions and resolutions.

When should I consider Mediation?

  • Mediation is always an option if you are thinking about taking your dispute to court. Other signs that mediation could be useful include:

  • if the dispute continues without resolution

  • if you want to keep a relationship affected by the conflict

  • if the dispute is upsetting and affecting your daily life

  • if the cost and time of a court case are prohibitive

  • if you want the chance to voice your concerns

  • if you want to resolve the dispute without a court or arbitrator’s decision

Top Reasons to Try Mediation

IT’S CONFIDENTIAL

Information shared in mediation cannot be disclosed or used later in court.

YOU CAN STILL GO TO COURT

If Mediation doesn’t solve your problems or needs, litigation is still possible.

IT’S A POSITIVE PROCESS

Everyone participates in the process until a mutual agreement is reached

YOU ARE IN CONTROL OF WHAT IS RESOLVED

We establish an agenda and work through all of the issues for both parties, step by step.

EASE FOR EVERYONE

The complexity of litigation is reduced. The Mediation process is faster and more direct.

EMOTIONAL MANAGEMENT

Safe spaces are created for both parties, including indirect communication in separate rooms.

PAPERWORK ASSISTANCE

Though we are not Lawyers, in most cases we can direct you to the correct paperwork you will need to fill out.

LOWER COST

Mediation is significantly less expensive than a day in court or other forms of litigation.

The woman in the middle has medium-length black hair and is looking upward, while the woman on the right has long black hair and is wearing a blue top. There are plants on shelves behind them.
